Terms and Conditions for Mark's Mobile Remapping

These Terms and Conditions ("Agreement") govern the provision of vehicle remapping services ("Services") by Marks Mobile Remapping, ("We", "Us", "Our") to the client ("You", "Your"). By engaging Our Services, you agree to be bound by these Terms and Conditions.

1. Definitions

ECU: Engine Control Unit. The electronic control unit that controls a series of actuators on an internal combustion engine to ensure optimal engine performance.

Remap/Remapping: The process of modifying the software parameters within Your vehicle's ECU.

Services: Any work undertaken by Marks Mobile Remapping, including but not limited to, diagnostic checks, ECU remapping, performance tuning, and any related advice or consultations.

2. Vehicle Condition and Suitability

2.1. You warrant that Your vehicle is in good mechanical working order, regularly serviced, and free from any known faults or warning lights that may affect the remapping process or the vehicle's performance post-remap. This includes, but is not limited to, the engine, turbocharger, clutch, gearbox, and braking system.

2.2. We reserve the right to refuse to carry out Services if, upon inspection or diagnostic testing, we identify any pre-existing faults or concerns with Your vehicle that We deem unsuitable for remapping. In such cases, a diagnostic fee may be charged.

2.3. We may conduct a pre-remap diagnostic check. While this aims to identify obvious issues, it is not an exhaustive mechanical inspection. It remains Your responsibility to ensure Your vehicle's overall health and suitability for modification.

3. Performance and Fuel Economy

3.1. All quoted performance figures (e.g., horsepower, torque, fuel economy gains) are approximate and illustrative. Actual results may vary depending on Your vehicle's individual condition, maintenance, mileage, existing modifications, fuel quality, driving style, and environmental factors.

3.2. We do not guarantee specific power increases or fuel economy improvements. While remapping is designed to optimise performance, results are not always quantifiable in every scenario or consistent across all vehicles.

4. Manufacturer Warranty and Insurance

4.1. Manufacturer Warranty: You acknowledge and understand that remapping Your vehicle's ECU may invalidate Your vehicle's manufacturer warranty, extended warranty, or any dealer-supplied warranty. It is solely Your responsibility to check with Your vehicle manufacturer or warranty provider regarding the impact of ECU remapping on Your warranty. We accept no liability for any warranty claims denied as a result of Our Services.

4.2. Insurance: It is Your legal responsibility to inform Your vehicle insurance provider of any modifications made to Your vehicle, including ECU remapping. Failure to declare modifications may result in Your insurance policy being invalidated, leading to serious legal and financial consequences in the event of a claim. We accept no liability for any issues arising from Your failure to inform Your insurance company.

5. Vehicle Components and Mechanical Stress

5.1. Remapping can increase the stress on certain mechanical components of Your vehicle, including but not limited to the engine, clutch, gearbox, turbocharger, drivetrain, and braking system.

5.2. You acknowledge and accept that while remapping is performed to safe industry standards, we do not provide a warranty for the longevity or failure of any mechanical or electrical components of Your vehicle, whether pre-existing or failing after the remapping. This includes components that may fail as a direct or indirect result of the increased performance or stress from the remap.

5.3. We are not responsible for any pre-existing issues or underlying weaknesses in Your vehicle that may become apparent or exacerbated after the remapping.

6. Aftercare and Faults

6.1. If You experience any issues or believe there is a fault with the remap provided by Us, you must contact Us immediately.

6.2. In the event of a suspected issue directly related to the remap, you must return the vehicle to Our premises for inspection and diagnosis. We will not be liable for any costs incurred if You choose to have Your vehicle inspected or repaired by a third party without Our prior written consent and the opportunity for Us to diagnose and rectify the issue ourselves.

6.3. We reserve the right to revert Your vehicle to its original factory software if, after diagnosis, we determine that the remap is not functioning correctly or if a suitable resolution cannot be found. No refund will be offered if the issue is not directly attributable to Our remapping software or if You refuse to allow Us to attempt a resolution.

7. Refunds and Guarantees

7.1. We offer a 30-day satisfaction guarantee on Our remapping services. If You are not satisfied with the remapping within this period due to an issue that we cannot rectify, we may, at Our sole discretion, offer to return Your vehicle to its original factory map.

7.2. Refunds, where offered, are strictly at Our discretion and will only be considered if a fault directly attributable to Our software is proven without doubt and cannot be rectified by Us.

7.3. No refunds will be given for “Stage 1.5”, "Stage 2" or "Stage 3" remaps, or any remaps for vehicles with existing hardware modifications, as these push beyond standard manufacturer tolerances and carry inherent higher risks.

7.4. No refunds will be given for services where the primary objective was solely increased MPG, as fuel efficiency gains are highly variable and cannot be guaranteed.

8. Payment

8.1. Full payment for Services is due upon completion of the work, unless otherwise agreed in writing.

8.2. We accept cash, bank transfer, major credit/debit cards.

8.3. In the event of non-payment, we reserve the right to pursue the outstanding amount through legal means, and You will be liable for any associated recovery costs.

9. Liability

9.1. To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, loss of profits, loss of earnings, mechanical failures, personal injury, death, or any other claims arising during or after the provision of Our Services.

9.2. Our total liability to You for any claim arising out of or in connection with these Terms and Conditions or the Services provided shall not exceed the price paid by You for the specific Services.

10. Data Protection

10.1. We will collect and process Your personal data in accordance with applicable data protection laws. Our Privacy Policy, available on request on how Your data is handled.

11. Governing Law and Jurisdiction

11.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

11.2. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. General

12.1. We reserve the right to update or amend these Terms and Conditions at any time. The most current version will always be available on Our website or upon request.

12.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3. No waiver of any breach of these Terms and Conditions shall be deemed a waiver of any subsequent breach of the same or any other provision.

By proceeding with the Services, you acknowledge that You have read, understood, and agreed to these Terms and Conditions.
